If my car was totaled in an accident am I responsible for the rental charges?

My car was totaled in an accident that was not my fault. When I got in contact with the other driver's insurance agent they said that, according to Texas law (the accident happened in Texas), they are not liable for the cost of the rental if my car turned out to be totaled. If it was reparable they would reimburse me. Anyone know what the facts are about this? Or where to look? I don't wanna get hoodwinked.
