What To Do To Fight An Eviction?
My cousin and her fiancee got layed off around the same time, and wasn't able to pay their rent. They went through a variety of unforeseen finacial disasters. Due to all this they received a "Notice To Pay Or Quit" from the apartment, due to over due rent. From there they had to go to court with the landlord. & the judge told both my cousin and the landlord to just settle it out of court to avoid unecessary costs. So my cousin settled with an agreement with the landlord & her lawyer. The settlement was that since my cousin's mother is receiving a significant disablity settlement from her previous work place. & would be giving my cousin money from it, that by the end of Dec. my cousin was to pay $3,000 to the landlord to settle costs. But my aunts settlement got postponed a few days do to a mistake done by her lawyer, so my cousin could only pay all she currently had into the rent which was $400. The landlord accepted her $400 & told her everything was good & that my cousin was just to pay the rest of the $3,000 by the end of Jan. But my cousin went in to see her landlord yesterday (jan 14th) just to make sure everything was still good, & update her on the status of her mother's settlement. & the landlord told her, that everything wasn't good. & that she already sent in the order to have my cousin locked out of her apartment. When my cousin reminded her of their agreement, & the landlord said that she doesn't recall that. & that she would've never agreed to such a thing when she did! So basically she screwed my cousin over on their agreement. There was a witness in the office when my cousin in the landlord made the agreement. But she has nothing on paper or documented to prove the agreement took place. So it's her word against the landlord. Currently she's struggling trying to stop the lock out. But she doesn't know her rights this far in the eviction process. She's currently going through bankrupacy. Is there anything she can do to stop the lock out? Does the landlord have the right to do this? Is there anyway she can do to keep her place? What are her options? Responses asap, would be greatly appreciated. Please & Thank you
